Created attachment 59472 [details] dmesg Since the driver moved to the iwlegacy folder, I've had problems. It works fine with 2.6.38. Symptoms... it won't find the AP and associate with it until I've run iwlist scanning a number of times. If I wait, it sometimes eventually connects. I think this is because the gnome network manager is scanning in the background... after the laptop boots, i log in and the network manager shows the 2.4GHZ APs that are in the area, but doesn't show my 5GHZ N AP.

i built a new kernel this morning with the above patch, and the wireless is now working perfectly :) Thanks!

It will. It take some time before patch propagate to Linus' tree.
